What is the SIPSI Posting Declaration?

The SIPSI posting declaration is a legal requirement for foreign employers who temporarily post workers to France. It enables the French authorities to ensure that posted workers benefit from the same working and pay conditions as French employees, in accordance with the provisions of the French Labour Code.
Indeed, for the entire duration of the posting and in connection with their activity on French soil, the posted worker must receive the remuneration provided for under the French Labour Code or the applicable extended collective bargaining agreement for their sector — “as if they were employed under a French contract”. This also applies to working hours, overtime, night work, daily and weekly rest periods, paid leave, public holidays, and so on. These are part of what is known as the “core provisions” of French public policy rules.

What is the purpose of the posting declaration?

The objective of this declaration is to ensure fair competition between European companies and to protect workers’ rights. By submitting the necessary information through the SIPSI platform, the employer demonstrates compliance with French social regulations and facilitates inspections by the Labour Inspectorate.

In 2022, 68% of inspections were conducted in companies with fewer than 50 employees, primarily in the construction, industrial, retail, and hospitality sectors. Who is subject to this obligation?

Any foreign company intending to post one or more workers to France, regardless of the sector (construction, transport, services, industry, etc.), must complete this declaration before the assignment begins.
Self-employed workers operating in France in certain sectors are also subject to this requirement.

What steps must be taken?

  1. Access the SIPSI platform: The employer must visit the official website of the Ministry of Labour (https://www.sipsi.travail.gouv.fr/) and create an account.
  2. Complete the declaration: The following information must be provided:
    • Identity and contact details of the foreign company
    • Identity and contact details of the legal representative in France
    • Information about the posted workers (name, nationality, job title, etc.)
    • Duration and location of the assignment in France
    • Applicable working and pay conditions
  3. Appoint a representative in France: It is mandatory to designate a person in France responsible for liaising with the French authorities in the event of an inspection.
  4. Submit the declaration: Once validated, a declaration certificate is issued and must be kept available in the event of an inspection.

What are the penalties for failing to declare?

Failure to comply with this requirement may result in an administrative fine of up to €4,000 per posted worker (and €8,000 in the event of a repeat offence). Additional penalties may also apply, such as the suspension of the ongoing assignment.
